 Accusatory instrument contained sufficient nonhearsay factual allegations that defendant operated a motor vehicle while impaired by the combined influence of alcohol and any drug or drugs, even though drugs defendant was alleged to have used were not listed in the Public Health Law; driving while impaired statute defendant was charged under did not contain limitation of “drug as defined in this chapter,” and contemplated chemicals beyond those listed in the Public Health Law. People v. Schell, 18 Misc.3d 972, 849 N.Y.S.2d 882 (N.Y.City Crim.Ct., 2008).

New York Reckless Driving

Where plaintiff pleaded guilty to reckless driving before police judge, and no property damage from reckless driving was charged in the information, but police judge certified to commissioner of motor vehicles that plaintiff’s reckless driving resulted in property damage, and the commissioner in compliance with mandatory duty suspended plaintiff operator’s license, plaintiff’s action against defendant, police judge, on theory of negligence to recover legal expense of recovering license and other damages was maintainable against defendant individually but not as a police judge, in view of the immunity from suit which surrounds judicial acts.
